Liability waiver

I: Guardian statement

As the legal representative of all my children mentioned and on my own behalf, I, the undersigned, confirm that I am fully aware and familiar with the content of the appendix to this »Liability waiver«. I hereby confirm that I have carefully read and fully understood this »Liability waiver«, thus I acknowledge and agree with the »Liability Waiver«.
I hereby state that I accept the »Liability Waiver« of the WOOP! Trampoline Park, WOOP! Karting, WOOP! Arena, WOOP! IZZIVI and WOOP! Murska Sobota (hereinafter »WOOP! premises«) for all my children.
I hereby state that I will not enable entry into WOOP! premises to someone else’s children unless their parents/custodians have signed the Liability Waiver, i.e. that I will not represent other children. Representation of someone else’s child without legal grounds is illegal. By enabling access to WOOP! premises to someone else’s child, I become their guarantor and thus liable for possible damages caused by or caused to a child. I am fully aware that omission of guarantor’s obligations might lead to my criminal liability for the criminal offence of omission (in accordance with Criminal Code of the Republic of Slovenia (Slovenian Official Gazette, no.: 50/12 with amendments)). I hereby state, that by signing of this Liability Waiver, I am fully aware of the consequences as stated herein.
I hereby state that I have informed my children of all the rules below and appropriately explained the rules to them according to their age.
Should I wish to organize a birthday party at the WOOP! premises, I confirm that I will inform the legal representatives (parents or legal guardians) of all birthday party attendees of the event. I agree to inform them of the provisions and appendix of this »Liability Waiver« and to obtain their full consent for the participation of all the attendees and to obtain their signed »Liability Waivers« and submit them to the WOOP! premises.

II: User statement

I hereby state that my participation in the activities at the WOOP! premises is entirely voluntary, of my own volition.
I understand that the activities involve an increased risk of injury, which may involve sprains, fractures, contusions or, in extremely rare cases, serious injuries, including the possibility of disability or death.
I expressly agree to act responsibly and attentively with regards to both myself and others and that I will adjust my activities at the WOOP! premises to my abilities. If I am uncertain whether I can perform a particular activity safely, I will not perform it. I also agree to take into account my own knowledge, experience and physical abilities, including my health condition.
I understand I am required to arrive in time for the activities at the WOOP! premises. If I fail to arrive on time, no refunds will be payable. The duration of the jumping session in the WOOP! Trampoline Park will be reduced in proportion to the length of the delay. If the length of the delay is greater than the duration of the session, the booked session will expire. In the WOOP! Karting arena, the booked session will expire if you fail to arrive prior to the race start time. In WOOP! ARENA, the bowling session will be reduced in proportion to the length of the delay (if the delay time is longer than the duration of your booked bowling session, your booked session will expire), while the booked sessions for Laser tag and Escape rooms will expire if you do not arrive by the time the games start.
I accept all instructions for safe equipment use provided by the Operator of the WOOP! premises. I agree to thoroughly read and follow all instructions, including all verbal instructions of the WOOP! premises staff. I concur that this does not necessarily imply direct supervision on their part.
I declare all my information regarding my age and health condition to be true. I am not (and will not be in future visits) under the influence of alcohol or other illegal substances, or medicines that affect psychophysical abilities. I have no diseases or physical disabilities that would pose a danger to me or others during activities at the WOOP! premises. I am not pregnant; I do not have sensory sensitivity problems; I do not have neurological disorders; I do not have binocular vision abnormalities, mental health problems or other severe medical conditions. If such cases occur, I will consult with my doctor and obtain clearance before performing an individual activity at the WOOP! premises, as the performing of this activity, can be endangering the individual’s health. After careful consideration of my psychophysical abilities, I take full responsibility for my actions and consequences.
I am liable for any damage I cause to the equipment at the WOOP! premises.
I am aware and explicitly agree that the WOOP! staff may ask every person to leave the WOOP! premises, without reimbursing the ticket price in the following cases:
  • if a person violates the staff instructions/rules at the WOOP! premises even after a two-time oral warning by the staff of compliance with the rules,
  • when staff assesses that the person is under the influence of i) alcohol or ii) prohibited substances, or iii) medicaments which have a significant impact on its ability to perform sports activities at the WOOP! premises safely,
  • if a person brings to the WOOP! premises an object, material or substance which, according to the assessment of the staff, can cause danger to other persons or equipment at the WOOP! premises and the person does not remove it after receiving an oral warning from the staff,
  • if the person does not have adequate or prescribed equipment for the safe performance of sports activities.
I hereby agree to assume all my responsibilities at the WOOP! premises, stated in this waiver are for indefinite period, after having signed this waiver, and that during this period of time, I am not obliged to re-sign this waiver upon further visits. I am aware that I can cancel this waiver at any time. Should my health condition or psychophysical abilities change, I undertake to inform the Operator of the WOOP! Premises in case of new visits.

Attachment

Instructions for safe equipment use

To visit and use the equipment of the WOOP! premises, you are required to register on the website www.woop.fun or at designated site of the individual location. Registration is available for persons over the age of 15, who may also register family members under the age of 15, for whom the parent or a legal representative will sign the »Liability Waiver« (e.g., one of the parents can register both themself and their child under the age of 15).
Before your first visit and use of the equipment of the WOOP! premises, you must agree to the »Liability Waiver« during online registration, and then personally sign or submit the personally signed »Liability Waiver« at the reception of the individual location. For persons under the age of 15, this shall be completed by parents, or legal guardians or that person may bring the “Liability Waiver” signed by their parents with them. At the same time, we reserve the right to call the parents or legal guardians by phone to verify they have really signed the “Liability Waiver.”
Upon ticket purchase or before entering the WOOP! premises each visitor must also purchase special (RFID) wristband or card, which represents a onetime purchase. Wristband\card provides an access to certain attractions, game identification and game control, safety video check in and use of lockers. The wristband\card is non-transferable and can be used solely by the registered wristband user. In the case of misuse, your wristband will be confiscated by members of staff. Lost wristbands\cards are subject to a replacement fee.
For use of certain attractions special WOOP! equipment must be purchased. This represents a onetime purchase when buying a ticket. For trampolin Park you will need special grip socks and for Karting balaclava. Use of certain WOOP! attractions without WOOP! equipment is not possible

1. Trampolin park

Jumping on the trampolines is completely safe if you follow all instructions. All instructions for the safe use are available as part of the »Liability Waiver« and as part of the following webpage www.woop.fun. Instructions are also presented in the form of a video at the WOOP! Trampoline park while further instructions are then given by qualified staff.
During your visit and use of the equipment at the WOOP! premises, the following limits shall apply:
  1. Adults and children over the age of 15 may use the equipment without supervision.
  2. Children between the ages of 6 and 15 may use the equipment without supervision after their legal representative has signed the »Liability Waiver«. However, it is advised that their legal representative accompany children under the age of 9.
  3. Children over the age of 3 and under the age of 6 may use the equipment solely if accompanied by their legal representative or another adult (the child’s legal representative or another adult must supervise the child’s jumping).
  4. Children under the age of 3 are not allowed to use the equipment.
The exception to the above limits is the visit and use of the equipment at the MINI WOOP!, the special part of WOOP! Trampoline park. MINI WOOP! can be visited by children over the age of 2 and under the age of 6 and they may use the devices independently, but only if accompanied by parents or legal representatives.
To enter the jump area, all visitors must prove their identity with their wristbands and watch the safety instructions video.
Safety rules to be followed by all jumpers:
  • We recommend wearing lightweight sports clothing while jumping.
  • While jumping, you must follow all safety instructions given by the Park Operator and staff.
  • Remove all jewelry and sharp objects before entering the free jump area.
  • You must always act in accordance with the limitations of your body. This means you must not try to go beyond your physical capabilities – choose activities you know you can perform safely.
  • If you wish to stop jumping, bend your knees.
  • Always land with two feet and aim to stay in the middle of the trampoline.
  • Always be aware of other jumpers.
  • Two jumpers are never allowed to use the same trampoline simultaneously. If anyone steps onto your trampoline, stop jumping immediately.
  • Jumping on a trampoline, which is already in use, is forbidden.
  • Landing on your head or neck is forbidden.
  • Landing on your back, unless you are on a vertical trampoline wall, for which previous experience is required, is forbidden.
  • Jumping on your head (air bag, foam pit) is forbidden.
  • Head or neck shots are forbidden (during dodgeball).
  • All somersaults are forbidden, except on the designated jump areas under the supervision of a park animator.
  • Jumping from a trampoline onto the padding around the edge of the mat is forbidden.
  • Lying on trampolines or mats is forbidden.
  • Pushing or pulling other jumpers or running is not permitted.
  • Climbing or grabbing safety netting is not allowed.
  • Wearing wet clothing is forbidden.
  • It is forbidden to have anything in the mouth while jumping (chewing gum, candy, etc.).
  • Bringing food or drink while jumping on the trampolines is prohibited.
  • Using trampolines while under the influence of alcohol, prohibited substances or medicaments that may affect psychophysical abilities is forbidden.
  • Operating mobile phones or VR glasses while jumping is forbidden.

2. Karting

Driving a go-kart is completely safe if you follow all instructions. All instructions for the safe use are available as part of the »Liability Waiver« and as part of the following webpage www.woop.fun. Instructions are also presented in the form of a video at the WOOP! Karting Arena while further instructions are then given by qualified staff.
During your visit and use of go-karts at the WOOP! Karting Arena, the following limits shall apply:
  1. Adults and children over the age of 15 may drive the go-karts without supervision.
  2. Children between the ages of 8 and 15 may drive the go-karts without supervision. However, it is advised that children under the age of 15 be accompanied by their legal representative or another adult while driving a go-kart.
  3. Children over the age of 6 may drive JUNIOR go-karts without supervision. Children between the ages of 6 and 8 may drive a go-kart, only if accompanied by their legal representative or another adult.
  4. Children over the age of 4 may be passengers in the twin-seater go-karts. The driver must be their legal representative or another adult.
  5. Children under the age of 4 are not allowed to drive the go-karts or be passengers.
To ensure safety, the speed of the go-karts must be adjusted according to age or time reached.
Prior to driving, all visitors must prove their identity with their wristbands and watch the safety instructions video.
Safety rules to be followed by all drivers:
  • Driving a go-kart is only possible when wearing a balaclava, neck brace and helmet and a special bracelet (RFID), which also enables the tap check-in for mandatory safety instructions video.
  • We recommend wearing comfortable casual clothing while driving. You are required to wear closed-toed shoes, with flat heels. Driving in open-toed sandals or high-heels is not allowed. Long hair must be pulled back into a ponytail. We take no responsibility for damage to clothing whilst driving.
  • All sharp objects and accessories that do not tightly fit around your body (scarf, headscarf, tie, pendants, etc.) should be removed before driving. We also recommend that you put away mobile phones, wallets and other items that could fall out of your pocket during your drive.
  • While driving, you must follow all safety instructions given by the WOOP! premises Operator and staff.
  • A green flag or a LED display indicates that there is no danger on the track and that you can drive a go-kart according to your psychophysical capacities.
  • A yellow flag or a LED display indicates that an accident has occurred on the track. You must slow down to a walking pace and drive very slowly around the track and may not overtake any other go-kart.
  • A blue flag or a LED display indicates that a driver is trying to overtake you. In this case, move to the marked section of the blue lane so that the faster driver can overtake you safely.
  • A red flag or a LED display indicates that you have behaved inappropriately on the track. Behaviors that are considered to be inappropriate are: stopping on track for no reason, unnecessary turning on the track, or bumping into another go-kart or safety barrier. The first signaling means warning, the second disqualification.
  • A black flag or a LED display signals that you have repeatedly behaved inappropriately on the track, resulting in disqualification. Driving in the wrong direction is followed by an immediate disqualification. In this case, you must drive back to the pit area (the area where you started the ride) and finish your ride early.
  • The checkered flag or a LED display indicates the end of your session. You should drive to the pit lane (the area where you started the ride).
  • Keep your driving in control at all times. This means not exceeding your psychophysical capacity and adjusting your driving speed to a speed where you can assure safe driving.
  • Driving while under the influence of alcohol, prohibited substances or medicaments that may affect psychophysical abilities is forbidden.

3. VR

The following limits and safety instructions apply when playing VR games at the WOOP! Arena:
  • Different VR games are appropriate for different ages, namely for children over 6 years, for children over 8 years, for children over 12 years and for children over 15 years. Game descriptions and age restrictions are located in front of the VR range or can be provided by our animator.
  • We recommend wearing comfortable casual clothing while playing games. We take no responsibility for damage to clothing whilst playing games.
  • While playing, you must follow all safety instructions given by the WOOP! premises operator and staff. That includes avoiding playing games when you are tired. You must also ensure to take at least a 15-minute break for every hour of VR play.
  • Players must be in control of their body at all times. This means that you do not go beyond your psychophysical abilities and adjust the game playing to your abilities.
Immediately discontinue playing and consult your physician if you experience any of the following symptoms: dizziness, blurred vision, eye or muscle twitches, disorientation, or any involuntary movement or convulsion while playing.

4. Bowling

The following limits and safety instructions apply when bowling at the WOOP! Arena:
  • Anyone ages 3 and up can bowl after signing a »Liability Waiver«.
  • Bowling shoes are required to bowl.
  • We recommend wearing comfortable casual clothing while bowling. We take no responsibility for damage to clothing whilst bowling.
  • While bowling, you must follow all safety instructions as well as any other instructions given by the WOOP! premises Operator and staff.
  • Bowlers must be in control of their body at all times. This means that you do not go beyond your psychophysical abilities and adjust to bowl within your abilities.
  • Crossing the black foul line is not allowed.
  • Keep hands out of ball return rack.
  • Walking on the bowling lane is not allowed.
  • In case of any technical issues always inform the staff.

5. Laser tag

The following limits and safety instructions apply when playing at the LASER TAG ARENA:
  • Anyone ages 6 and up can play at the Laser Tag Arena after signing a »Liability Waiver«.
  • We recommend wearing comfortable casual clothing while playing. We take no responsibility for damage to clothing whilst playing Laser Tag.
  • While playing, you must follow all safety instructions given by the WOOP! premises Operator and staff.
  • Players must be in control of their body at all times. This means that you do not go beyond your psychophysical abilities and adjust the game playing to your abilities.
  • Climbing and touching or hanging on the equipment during the game is not allowed. In particular, climbing and touching the stage props (airplane, van, car and suchlike).
  • Running, pushing, pulling or laying on the floor is also not allowed or performing any sudden and uncontrolled movements is not permitted. Laying on the floor is also not allowed. Pay attention to the players around you at all times.
  • Laser tag equipment (phaser and vest) should only be used in a prescribed manner.

6. Escape room

The following limits and safety instructions apply when playing in the escape rooms:
  • Different escape rooms are appropriate for different ages, namely for children over 8 years, children over 10 years and for children over 15 years. Children between the ages of 10 and 15 can play in the escape room only when accompanied by their parents or adults. Game descriptions and age restrictions are located at the reception or can be provided by our animator.
  • All users are aware that the game itself represents the intellectual property of the provider or its contractual partner and undertake not to violate the prohibition on disclosure of secrets and solutions to individual puzzles.
  • Taking pictures or video within any of our escape rooms is not allowed.
  • The use of mobile phones (whether for pictures, videos, flashlight, calculator) is not allowed.
  • While playing, you must follow all safety instructions given by the WOOP! premises Operator and staff.
  • Escape rooms are mind games, so never use brute force in solving puzzles. You will never be required to use any strength or physical force.
  • You will notice DO NOT TOUCH stickers in the escape rooms. These stickers mean that you should not touch these items; however, that does not mean that they cannot be part of the puzzles; they just need to be used without touching.
  • Each item or hint is used only once. After you used it, you will no longer need it through the rest of the game
  • The use of force and activities such as running or jumping are not allowed during the game.
  • If you need help with the game, press the help button on the Autohelp Hint System (AHS). You are allowed to ask for a hint every 10 minutes.
  • If you need additional help or staff for any other reason, press the red button on the side of the AHS. You can also get extra support by waving, and our staff will come to help you, as they are always watching and listening to you during the game.
  • You will also notice PANIC stickers in the escape room. Press these sticker buttons if you wish to leave the room. If you want to leave the room, you can also wave, and the staff will pick you up as they are always watching and listening to you during the game.
  • The remaining time to complete the game can be monitored on the AHS system.

7. WOOP! Izzivi

The following limits and safety instructions apply when playing WOOP! IZZIVE:
  • WOOP! IZZIVI represent different rooms with different challenges based on speed, agility and solving puzzles.
  • IZZIVI are appropriate for children from the age of 6. Adult accompaniment is mandatory for children from 6 to 9 years of age. From the age of 9 to 12, the accompaniment of an adult is recommended.
  • Izzivi can be played in teams of min 2 and max 6 players.
  • Some challenges in certain rooms needs certain physical effort in order to be solved so appropriate physical condition have to be meet.
  • We recommend wearing comfortable casual clothing while playing.
  • Running, pushing, pulling, or laying on the floor is also not allowed or performing any sudden and uncontrolled movements is not permitted.

B: Operator responsibilities

The Operator of the WOOP! premises is company TPLJ d.o.o., Leskoškova cesta 2, 1000 Ljubljana, court entry no.: 7272618000 (hereinafter: »the Operator« or »TPLJ«).
The Operator will not be held responsible for any harm or damages caused to users and visitors or their possessions.

C: Video surveillance

With regard to ensuring the safety of employees, visitors and physical property, as well as monitoring entry and exit the WOOP! premises, the Operator uses a video surveillance system. The Operator has opted for video surveillance of the WOOP! premises in accordance with the guidelines of Article 75, PDPA-1 on the surveillance of the commercial properties of the WOOP! premises. The personal data collected, which include video recordings, as well as the time and place of the recording, are protected from unauthorized access. Video recordings are stored for at least 30 days, and up to one year, this applies to the video recordings of all cameras connected to the recording system. After the specified period of time, all data are deleted, with the exception of injury data, that are kept for the period of 5 years.

D: Use of photographs and video recordings

TPLJ d.o.o. will not without your consent record or publish any photo or video material, where certain individual could be identified. This kind of use will only take place in case of special, additional consent at the time of registration or before publishing.
The undersigned expressly agrees that he or she will not use the photographs or images taken by himself or his child at the WOOP! premises for commercial purposes without the prior written consent of TPLJ.

E: Warning

Only the correctly completed »Liability Waiver« is valid. A legal representative shall sign the »Liability Waiver« for persons under the age of 15. By signing the »Liability Waiver«, the legal representative takes responsibility for consequences resulting from the failure to comply with the safety rules and the oral warnings of the WOOP! premises staff. As a legal representative of the child, I am aware that the use of the equipment at the WOOP! premises, in disregard of instructions for safe use of the equipment, increases the risk of injuries that may involve sprains, fractures, contusions or in extremely rare cases even serious injuries, including the possibility of disability or death of the user. In accordance with signed »Liability Waiver«, the legal representative discharges the Operator of the WOOP! premises from liability for personal injury of the user or his material goods due to failure to comply with the safety rules and express oral instructions from the staff at the WOOP! premises. The signatory of the »Liability Waiver« expressly states that in case of injury or damage, they will not file a civil action or start criminal prosecution against the Operator of the WOOP! premises.
On activities in WOOP! premises you must arrive on time. In case of delay, there is no possibility of a refund. In WOOP! TRAMPOLIN PARK, the jumping time is reduced accordingly by the time of delay. If the delay time is longer than the reserved jumping time, your slot is cancelled. In WOOP! KARTING your slot is cancelled if you do not arrive at least 10 minutes before your booked slot. In WOOP! ARENA, the time of the bowling game is reduced accordingly by the time of the delay (if the time of the delay is greater than the reserved time of the bowling game, your slot is cancelled). The slot for Laser tag game, Escape Room game and WOOP! IZZIVI game is cancelled if you don’t arrive at least 10 minutes before your session.
Staff can ask any person to leave WOOP! premises, without refund of the ticket price in the following cases:
  • if the person violates the staff instructions / WOOP rules! premises even after a double verbal warning from staff to comply with the rules / instructions,
  • when staff estimates that a person is under the influence of i) alcohol or ii) illegal substances or iii) drugs that visibly affect their ability to safely carry out activities in WOOP! premises,
  • if the person in WOOP! premises possess an object or material or substance which, according to the staff, may pose a danger to other persons or devices in the WOOP! premises and is not removed by the person following a verbal warning from the staff,
  • if the person does not have a suitable or prescribed equipment for the safe performance of activities.
